WHAT WE DO

 

The New York Foundation for Fair Contracting (NYFFC) is a non-profit organization established in 2011 to support, promote, and encourage fair contracting in New York State. The NYFFC does it part to ensure that public works projects are completed fairly – for all parties involved.

Fair contracting means that all contractors follow state construction guidelines, safety protocols, and wage requirements.  When contractors don’t follow the law and act irresponsibly, workers, taxpayers, and responsible contractors suffer.  Workers are deprived of fair wages due to fraud and misclassification.  Public bodies and taxpayers are at risk of due to work being done “cheaper,” to save on up-front costs.

The NYFFC works to prevent cheating and irresponsibility in public works construction.  The NYFFC works to level the playing field through relationship building, educational seminars, bid monitoring and protests, and at times, assisting employees file complaints with the appropriate state or federal agencies.

Relationship Building & Advocacy

Public works construction projects start with the public body.  The State, State agencies, public authorities, towns, cities, and villages all spend taxpayer dollars on public infrastructure projects.  The NYFFC works to ensure that public money is spent responsibly.  We do this by:

  • Encouraging public bodies to follow existing responsible bidder laws
  • Encouraging and assisting municipalities to adopt local responsible bidder laws
  • Providing resources and training to public agents responsible for awarding public contracts

Bid and Contract Monitoring

The NYFFC works to ensure compliance with existing wage, hour, safety, and competitive bidding laws, misclassification statutes, and debarment orders by tracking and monitoring the public works competitive bidding process.  By using publicly available data, the NYFFC identifies upcoming jobs and bid opportunities and monitors the competitive bidding process.

Worker Complaints

The NYFFC can help workers through the confusing process of filing a complaint with a state or federal agency.  NYFFC staff members are available to review complaints, and provide guidance where necessary.  However, the NYFFC is not an investigative agency.  Worker complaints are presented to the appropriate state or federal agency for agency investigation.  Contact us for more information or for help with a worker complaint.
